Welcome to Nurovell. These Terms of Sale ("Terms") govern your access to and use of the website located at nurovell.com (the "Site") and your purchase of any products offered on the Site. The Site is owned and operated by Alpha Enterprises LLC ("Nurovell," "we," "us," or "our"). By accessing the Site, placing an order, or otherwise using our services, you ("you," "your," or "customer") agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use the Site or purchase any products from us.

You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for personal, non-commercial purposes only. You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction, to make a purchase on the Site.

Your privacy is important to us. Our collection, use, and disclosure of your personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the practices described in the Privacy Policy.

We employ commercially reasonable administrative, technical, and physical safeguards designed to protect the information you provide. All payment transactions are processed through PCI-DSS compliant third-party payment processors. We do not store your full payment card details on our servers. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site, use of the Site, or access to the Site without our express written permission.

When using the Site, you agree that you will not:

• Use the Site for any unlawful purpose or in violation of any applicable local, state, national, or international law.
• Attempt to gain unauthorized access to any portion of the Site, other user accounts, or any systems or networks connected to the Site.
• Use any automated script, bot, crawler, scraper, or data-mining tool to access, extract, or collect content or data from the Site without our prior written consent.
• Interfere with, disrupt, or place an undue burden on the Site or the networks or services connected to the Site.
• Transmit any viruses, worms, malware, or other harmful or malicious code.
• Upload or transmit any content that is unlawful, harassing, defamatory, abusive, threatening, obscene, or otherwise objectionable.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms.

All products purchased from Nurovell are intended for your personal use only and not for resale. You may not purchase our products for the purpose of reselling, redistributing, or otherwise commercially exploiting them. We reserve the right, with or without notice, to cancel or reduce the quantity of any order that we believe, in our sole discretion, may result in the violation of these Terms, including orders that appear to be placed by dealers, resellers, or distributors.

Nurovell products are dietary supplements formulated to support general nerve health and overall wellness. These statements have not been evaluated by the Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease. Nothing on the Site is intended to be, and should not be interpreted as, medical advice or a substitute for professional medical advice, diagnosis, or treatment.

The information provided on the Site is for general informational and educational purposes only. Individual results may vary. Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding a medical condition or before starting any new supplement, particularly if you are pregnant, nursing, have a known medical condition, or are taking prescription medication. Never disregard professional medical advice or delay in seeking it because of something you have read on the Site.

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue any product (or any part or content thereof) without notice at any time. All prices are displayed in United States dollars (USD) unless otherwise indicated. Applicable taxes and shipping and handling charges are calculated and displayed at checkout.

We strive to display accurate product information, including descriptions, images, and pricing. However, we do not warrant that product descriptions, pricing, or other content on the Site is accurate, complete, reliable, current, or error-free. In the event of a pricing or product-information error, we reserve the right to refuse or cancel any orders placed for the affected product, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and we cancel your order, we will issue a refund in the amount of the charge.

Payment is due at the time you place your order. By submitting your payment information, you represent and warrant that you are authorized to use the designated payment method and you authorize us (and our third-party payment processors) to charge your payment method for the total amount of your order, including product price, applicable taxes, and any shipping and handling fees.

Charges will appear on your credit card or bank statement as NUROVELL. If we are unable to process or verify your payment, we may cancel your order. We reserve the right to cancel any order if we suspect fraud, unauthorized, or unlawful activity.

When you place an order through the Site, you are submitting an offer to purchase the products in your cart subject to these Terms. Your receipt of an order confirmation (for example, an on-screen confirmation or a confirmation email) acknowledges that we have received your order; it does not constitute our acceptance of your order.

We reserve the right, at any time after receiving your order, to accept or decline your order, or any portion of your order, in our sole discretion, for any reason, including limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our fraud-avoidance or credit-verification processes. A contract of sale is formed only when we ship the products to you. Title and risk of loss for products pass to you upon our delivery of the items to the shipping carrier.

At checkout, you may choose to buy Nurovell products one time, or you may enroll in our Subscribe & Save program to receive recurring shipments at a discounted price. If you enroll in Subscribe & Save, you are signing up for an automatically recurring subscription. By enrolling, you authorize us to automatically charge your payment method on file at the price and on the delivery interval you selected (for example, every 30, 60, or 90 days) until you cancel. Each recurring order ships automatically on your chosen interval, and your saved payment method is charged at the time each order is processed.

Account Updater. To help prevent interruptions to your subscription, we and our payment processors may use card account-updater services offered by card networks and issuing banks. This means that if your saved card is reissued, or its number or expiration date changes, the updated card details may be automatically applied to your subscription so that your recurring orders continue without interruption.

How to Cancel. You may cancel your subscription at any time. You must cancel your subscription at least forty-eight (48) hours prior to your next scheduled billing date to avoid being charged for and shipped the next order. Cancellations received after that cutoff will apply to the following billing cycle rather than the order that has already begun processing. You can manage or cancel your subscription at any time through your Self-Serve Portal, by calling our support team at 1-302-335-7108, or by emailing us at support@nurovell.com. When you cancel, you keep any membership benefits through the end of your current, already-paid billing cycle.

Changes to Price or Plans. We reserve the right to change subscription pricing, product formulations, delivery intervals, and program terms from time to time. If we make a material change to the recurring price of your subscription, we will provide you with advance notice (for example, by email) and, where required by law, an opportunity to accept the change or cancel before it takes effect. Your continued participation in the program after such notice constitutes your acceptance of the change.

We process and ship orders within forty-eight (48) hours on business days (Monday through Friday), excluding weekends and holidays. Standard shipping via USPS typically arrives within three to five (3–5) business days, and expedited shipping via FedEx or UPS typically arrives within one to two (1–2) business days after your order has shipped. Delivery time frames are estimates and are not guaranteed. We are not responsible for delays caused by the carrier, weather, customs, or other circumstances beyond our reasonable control. When your order ships, we will send a shipping-confirmation email containing your tracking number so you can follow your package to delivery. Carrier tracking information, including a "delivered" status marked by the carrier, constitutes confirmation that your order was delivered to the address you provided. If tracking shows your order as delivered but you have not received it, please first check with members of your household and neighbors, and then contact the carrier and our support team at support@nurovell.com so we can assist you.

We stand behind our products with a 90-day money-back guarantee. If you are not completely satisfied with your purchase for any reason, you may request a full refund within ninety (90) days of the delivery date of your order. Approved refunds are issued to your original payment method. To request a refund under this guarantee, simply email our support team at support@nurovell.com and we will guide you through the process.

Depending on the circumstances, we may ask you to return the product before a refund is issued. After we receive your return, it generally takes seven to ten (7–10) business days for our team to inspect and process the refund. Once processed, please allow additional time for the refund to appear on your statement; depending on your bank or card issuer, it can take up to thirty (30) days for the refunded amount to post to your account. We may make available pages, accounts, and profiles on third-party social media platforms. Any content you post to our social media pages, or that references Nurovell, is subject to the terms and privacy policies of the applicable platform in addition to these Terms. You are solely responsible for your interactions on social media. We are not responsible for the content, accuracy, or practices of any third-party social media platform, and your use of those platforms is at your own risk.

The Site and all products, information, content, and materials made available through the Site are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the Site or the servers that make it available are free of viruses or other harmful components. No advice or information, whether oral or written, obtained by you from us or through the Site will create any warranty not expressly stated in these Terms.

To the fullest extent permitted by applicable law, in no event shall Nurovell, Alpha Enterprises LLC, or their respective officers, directors, employees, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or your inability to access or use, the Site or any products purchased through the Site.

In no event shall our total aggregate liability to you for all claims arising out of or relating to these Terms, the Site, or any product exceed the greater of the amount you actually paid to us for the product or transaction giving rise to the claim, or five hundred United States dollars (USD $500.00). The limitations in this section apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Binding Arbitration. You and Nurovell agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any product purchased through the Site — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court if it qualifies.

The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. This agreement to arbitrate is governed by the Federal Arbitration Act ("FAA"). The arbitrator shall apply the substantive law of the State of Florida, without regard to its conflict-of-law principles. The arbitrator's award shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver. You and Nurovell agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

30-Day Right to Opt Out. You may opt out of this arbitration and class-action-waiver agreement within thirty (30) days after you first accept these Terms by sending a written notice of your decision to opt out. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration, and must be mailed to: Alpha Enterprises LLC, ATTN. If you opt out within this period, neither you nor Nurovell will be bound by the arbitration and class-action-waiver provisions of this section.

You agree to defend, indemnify, and hold harmless Nurovell, Alpha Enterprises LLC, and their respective officers, directors, employees, agents, licensors, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable attorneys' fees) arising from or related to: (a) your use of and access to the Site; (b) your violation of any provision of these Terms; (c) your violation of any third-party right, including any intellectual property, privacy, or proprietary right; or (d) any claim that content you submitted caused damage to a third party. This indemnification obligation will survive the termination of these Terms and your use of the Site.

The Site may contain links to third-party websites or resources that are not owned or controlled by us. We provide these links only as a convenience and are not responsible for the content, products, services, or practices of any third-party websites. The inclusion of any link does not imply endorsement by us. You access third-party websites at your own risk and subject to the terms and privacy policies of those websites.

The Site may allow you to submit reviews, testimonials, comments, photos, and other content ("User Content"). Testimonials reflect the real-life experiences of individuals; however, they are individual results, and results may vary. We do not claim, and you should not assume, that all customers will achieve the same or similar results.

By submitting User Content, you grant Nurovell a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in any media and for any purpose, including marketing and promotion. You represent and warrant that you own or otherwise control all rights to the User Content you submit and that it does not violate these Terms or the rights of any third party.

All content on the Site — including text, graphics, logos, icons, images, audio and video clips, digital downloads, data compilations, and software, as well as the Nurovell name and logo — is the property of Alpha Enterprises LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any such content without our prior written permission.

We respect the intellectual property rights of others and comply with the Digital Millennium Copyright Act ("DMCA"). We reserve the right to remove content alleged to be infringing and to terminate the accounts of repeat infringers.

By using the Site or making a purchase, you consent to receive electronic communications from us, including order confirmations, shipping notifications, account and subscription updates, service announcements, and, where you have opted in, promotional messages. You agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing. This consent is provided in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable law.

You may not assign or transfer these Terms, or any of your rights or obligations under them, without our prior written consent. We may freely assign or transfer these Terms and our rights and obligations under them, in whole or in part, without restriction and without notice to you. These Terms will bind and inure to the benefit of the parties and their permitted successors and assigns.

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of that right or provision. No waiver of any term of these Terms will be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms will not constitute a waiver of such right or provision.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

We may terminate or suspend your access to all or part of the Site at any time, with or without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users, to us, or to third parties, or for any other reason. All provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, limitations of liability, and dispute resolution.

If you opt in to our SMS/text messaging program, you consent to receive recurring automated text messages from Nurovell at the mobile number you provide, including order and shipping updates and, where you have separately opted in, marketing and promotional messages. Consent to receive marketing text messages is not a condition of any purchase.

Message frequency varies. Message and data rates may apply. You can opt out of the program at any time by replying STOP to any message; after you send STOP, we will send a single confirmation message and will no longer send you SMS messages unless you re-enroll. These Terms, together with our Privacy Policy, Cookie Policy, Return & Refund Policy, Shipping Information, and any other policies or notices posted on the Site, constitute the entire agreement between you and Nurovell regarding your use of the Site and your purchase of products, and supersede all prior or contemporaneous understandings and agreements, whether written or oral. Any ambiguities in the interpretation of these Terms will not be construed against the drafting party.
